Srs question for lolyer types - do you consider both the risks to the company of staying on Tw****r and the risks of not being there? Would you advise clients to keep a presence if only to refute impersonators, or to go completely silent?

I don't think it's even really a legal question at the moment - there are lots of exotic theories about what kinds of liability Twitter might be creating for itself (outside of getting sued by regulators, etc.) but I think they're a bit out there. It's mainly a marketing issue, and the legal aspect of it is the absence of remedies, or at least timely ones.
My personal view is that right now, Twitter is basically 8chan. Brand activity is now disproportionately risky. There's no revenue driver in getting into a Twitter slapfight with a Nazi. Idle whatever accounts you have (without deleting them) and keep your head down. Don't place new ads and don't use Twitter for active engagement any further.
