I've thought about (and hated) Trump for way longer than Jules, but for some reason I'm more excited about the prospect of him getting perp-walked than Trump.

Time to break out the tots and pears. This is encouraging, but sightings of Roodles performing Buffalo Gals in shitty bars for drinks a la would be even more encouraging.

Trump is a horrible person but at this point he can be seen a bit like an animal, “Your fingers smell of Big Mac, of course he was going to snap!” Where as Giuliani seems to get joy out of being nasty for nasty’s sake.

Today ol' Rudy told the court that he won't bother contesting the actual falsity of his statements, but he still has no liability cuz his bullshit was constitutionally protected.
|
Rudy fucked around so hard with the discovery process in the defamation case that today he received the ultimate find-out, a " fuck you; you're liable" order from the federal judge presiding over the case. The judge entered judgment against Roodles as to liability on all the plaintiffs' claims as a sanction for discovery violations. The judge will set a three-day trial on damages only.
Roodles also got ordered to produce a bunch of records he should have produced long ago but didn't. He's individually liable for over $89K in attorney fees the plaintiffs incurred in connection with a prior motion to compel discovery, and is also liable for the as-yet undetermined fees they incurred in connection with their sanctions motion. Certain of Roodles' business entities are liable for over $43K in plaintiffs' attorney fees, with Roodles being personally liable if the businesses don't pay up.
Couldn't happen to a shittier shitbag.

Rudy Giuliani's Drinking Probed in Trump Jan. 6 Investigation – Rolling Stone
The Trials and Tribulations of Rudy Giuliani
Quote:
Here’s the thing: For an advice of counsel defense to stick, a defendant needs to satisfy a few key elements. One of them is that the client (here, Trump) needs to have made full disclosure of all the material facts to the lawyer. And that generally requires the lawyer to have actually fully understood what was conveyed.
It’s not hard to see why laying out all the facts to a lawyer blitzed off his ass would fail to qualify here. “I told my lawyer, but he was drunk” is likely not an effective advice of counsel defense.
|
Quote:
A client also must also prove that he was acting in good faith by reasonably following that lawyer’s advice. Again, it’s not generally good faith to rely upon the advice of a lawyer whom you know to be drunk. On Election Night, for example, it was an allegedly soused Giuliani who advised Trump to go out and declare victory early, even while everyone else was frantically giving Trump the nix sign. If your drunk counsel advises something like that, while everyone else who is sober in the room pleads with you not to do it, it’s simply not good faith to follow the one drunk lawyer’s advice.

I picture Rudy election night in a toga making frequent trips to the bathroom, always coming out more energetic occasionally screaming about vote stealing and Tigers blood.

Re: Rudy Giuliani Appreciation Thread
Can't imagine even a PAB lolyer trying to construct an advice-of-counsel defense based on statements of Roodles, whose defense to suggestions that he might have a bit of an issue with the drinkiepoos essentially boiled down to, "I've had so much booze flowing through my system at all times for so many years that I'm fully functional that way."

It's more than a little disappointing that the article doesn't mention that time he showed up for New York Magazine interview with his pant unzipped and a drool rope oozing down his suit jacket, but still, Roodles be drankin'.

I wasn't following the trial that closely. I had learned what he said about testifying, but I didn't follow up on what he actually did.
Like Betty Bowers, I do wonder how much worse it would have been had he actually followed through. I'm mildly disappointed.

Re: Rudy Giuliani Appreciation Thread
Ol' Roodles was blabbering about how he planned to take the stand and prove that all the shit he said about those poll workers was true. That wouldn't exactly have been the most relevant testimony in the history of civil litigation, what with the judge having entered a "fuck you, you're liable" order back in August as a sanction for some rather egregious discovery violations and this trial being a damages-only sort of thing.
This brings to mind that scene toward the end of The Verdict (Paul Newman, James Mason) where the jury foreman asks the judge if the jurors are allowed to award more money than the plaintiff requested.

Same shit with Alex Jones. He fucked around during the discovery process and then found out. He complained bitterly when they wouldn't let him offer a defense during the damages portion of the trial, but he had his chance and he fucked it up.
What is it with drunken right-wing dirtbags?

In retrospect perhaps this was not a particularly great moment in advocacy:
Quote:
"What the plaintiffs' counsel are asking for in this case is the civil equivalent of a death penalty," Sibley told jurors in brief opening remarks.
