Ohio's one of those shitheaded states where judges are elected in good old fashioned, down-home, head-to-head elections. That can result in abundant political hackery, but my experience with Ohio municipal court judges was 100% positive. It's a tough job, and you really have to want it to run in the first place. Dipshits and incompetents generally don't want anything to do with a municipal court judgeship.

I voted for a lot of Republicans over the years, and p. much all of them were Ohio judges. If someone could manage a docket, handle trial and pretrial processes smoothly, and genuinely cared about giving litigants a level playing field, that was more than enough for me.

The jibhead part of this story is that it makes Ohio Supreme Court Chief Justice Maureen O'Connor look like a good guy. Ohio has a procedure by which litigants can petition the CJ to disqualify a trial court judge from a pending case. Happened to us once. We got a big verdict in a personal injury case against a power line company, and defense counsel wanted to disqualify the judge from deciding a post-trial motion that could have added a ton of additional money to the judgment. We won that one (https://law.justia.com/cases/ohio/supreme-court-of-ohio/1999/1999-ohio-7.html). 

O'Connor's suspension order in this case was the right thing to do, but it masks the fact that she's a giant piece of shit, a bought-and-paid-for stooge of the insurance industry and big business. Back in the day, insurance companies were very successful at getting the Ohio legislature to pass toart refoarm legislation, only to have the Ohio Supreme Court and its 4-3 ordinary people favoring majority shoot it down on a variety of state constitutional grounds. O'Connor's election to the Supreme Court in 2002, financed with fucktons of insurance industry money, was the beginning of the end for that state of affairs.

So yeah. Fuck Judge Pinkey Carr for: (1) being an asshole in her own right; and (2) making Maureen O'Connor appear to be a non-asshole.

It is unclear why he was planning to visit New York, the source said, but they believed it was tied to the US presidential election being just around the corner.

Intelligence officials feared Giuliani &#8212; a former federal prosecutor who is now a Trump lawyer and freelance White House investigator &#8212; was being used to feed Russian misinformation to the president, four former officials familiar with the matter told the newspaper.

Their warning to Trump, one of the officials told the newspaper, was: "Do what you want to do, but your friend Rudy has been worked by Russian assets in Ukraine.&#8221;

Has anybody watched Borat 2?  Let me tell you, it's clear what Rudy was reaching for in his pants.  It's not ambiguous.  He even makes some creepy pervert noises. In case you somehow missed this one, it seems like Trump announced that his lawyers would be giving a presser at the Four Seasons (tweet deleted) in Philly. Either someone forgot to book it, or the Four Seasons said "no thanks", but one way or another it wasn't going to be at the Four Seasons hotel. So they searched Philly and found Four Seasons Total Landscaping and actually thought that would work somehow :lol: It's just a pure bonus that it's next to a porn shop and across from a crematorium :giggle:

The Four Seasons Total Landscaping debacle is why we can't have parody anymore. These people simply cannot be outclowned.

Anyway, my preferred theory is staffer X had not actually got the message to make the booking before Trump made his first tweet. And of course Trump staffers don't say no to the boss, so "yeah sure we've booked the Four Seasons". Get on the phone to Four Seasons Hotel. Hotel: "sorry that's against our No Nazis policy" or at least "sorry, we're booked out, we could fit you in next week? how about next week?" And somebody decided "any Four Seasons" would be a better compromise than "any luxury hotel". :shrug:

“Default judgment”, new one to me.

That usually happens at the outset of a lawsuit when the plaintiff files a complaint, gives notice to the defendant, and the defendant doesn't respond within the time provided by law. No point in having a trial if the defendant doesn't want to contest the plaintiff's allegations. If it's a rinky dinky promissory note case where damages are easy to calculate, the plaintiff can usually get a sum-certain default judgment with no kind of hearing at all.

This here is something completely different. This shit happens when the lawsuit is hotly contested and one party serves written discovery requests on the opponent, who interposes a bunch of bogus objections and/or provides half-assed answers. After the lawyers go through the obligatory dog and pony show that is the mandatory conferral process, the party seeking discovery files a motion to compel. When the motion is fully briefed, and maybe a hearing occurs, the judge shoots down the bogus objections, orders the opposing party to provide complete discovery responses by a date certain, and maybe makes the opposing party pay the fees and costs the discovering party incurred in connection with the motion to compel.

After all that, if the opposing party still refuses to provide discovery and/or provides only half-assed responses, the discovering party can move for sanctions. There's a wide array of sanctions a judge can impose for willful discovery violations. The order in these cases is basically the Holy Grail of sanctions, a "Fuck you, you're liable" order. Jonesy's discovery violations were so egregious that the judge found in the plaintiffs' favor on all the liability issues right now, such that the only question left for trial is "How much?"

Couldn't have happened to a more malodorous piece of shit. :yup:

It is indeed rare as all fuck. My mentor in the biz was (still is, I think) an asbestos injury litigator, and mass tort product liability cases are probably the most fertile ground for orders like this. Never happened in any of our cases, but you'd hear things and after the internet got big, orders imposing sanctions got circulated on trial lawyer listservs. 

In large companies, muckity mucks in a board room decide "We're not turning that shit over, regardless of what our tall-building outside counsel lawyers and that robe-wearing sissy have to say." Here, it was apparently just Jonesy and the voices bouncing around inside his head.

What I'm gathering here is the only way to win this award is to be a titanically huge asshole. :)

Fed. R. Civ. P. 26(c) and its state law clones provide that a civil litigant can get a protective order for "good cause." For a shockingly long time, the big companies argued, "We can't turn that over; it's so goddamn incriminating that not only this plaintiff but the thousands of others injured by our clownishly defective product will sue the fuck out of us." And for a shockingly long time, courts said, "Yep, that there is good cause for a protective order."

A lot of successful mass tort litigation resulted from companies accidentally producing an incriminating document or two in a single case, followed by plaintiff's counsel in that case sharing the document with other plaintiff's lawyers.

Similar things happen in other systems though. Here we have a no-fault accident compensation system - you don't get to sue, but there is an agency that pays out the accident compensation and in a separate process other agencies that investigate and prosecute (if warranted) the responsible parties.

Nonetheless the rules are bureaucratic and don't cover all cases. In particular chronic conditions caused by overuse don't get compensation as they aren't tied to a specific "accident". It's not uncommon for people to come up with fictitious accidents in order to access the treatment and support they need.

2. When Giuliani hired Ms. Dunphy in January 2019, he was at the height of his influence, serving as the personal lawyer for then-President Donald Trump. He had fashioned himself publicly as a major player in American politics, a successful businessman, and an important powerbroker who wielded enormous control over others.

3. Giuliani worked aggressively to hire Ms. Dunphy, offering her what seemed like a once-in-a-lifetime opportunity to work as his Director of Business Development with a salary of $1 million per year plus expenses. As an added inducement, Giuliani also offered to provide pro bono legal representation to Ms. Dunphy in connection with an ongoing dispute arising from an abusive ex-partner. To Ms. Dunphy, the chance to work for an influential politician once dubbed &#8220;America&#8217;s Mayor,&#8221; combined with the prospect of free legal representation by a former United States Attorney for the Southern District of New York, was a rare opportunity that was simply too good to pass up.

4. But Giuliani&#8217;s offer came with a significant catch: Giuliani was in the midst of an acrimonious divorce, and he told Ms. Dunphy that her pay would have to be deferred and her employment kept &#8220;secret&#8221; until the divorce proceedings finished. He claimed that his &#8220;crazy&#8221; ex-wife and her lawyers were watching his cashflow, and that his ex-wife would &#8220;attack&#8221; and &#8220;retaliate&#8221; against any female employee that Giuliani hired. Giuliani promised Ms. Dunphy that his divorce would be resolved &#8220;any day now,&#8221; and therefore the deferral of her pay and the need to keep her employment secret would soon end. Ms. Dunphy reluctantly agreed to defer her pay and not to publicize her employment because she viewed the job, the salary, and the free legal
representation as being worth the wait.

5. Unfortunately, Giuliani&#8217;s seemingly generous offers were a sham motivated by his secret desire to pursue a sexual relationship with Ms. Dunphy&#8212;in total disregard for the restraints that should have protected her as his employee and client. As Giuliani later admitted in a recorded statement, he &#8220;wanted [Ms. Dunphy] from the day [he] interviewed [her].&#8221;

6. Giuliani began abusing Ms. Dunphy almost immediately after she started working for the Defendants. He made clear that satisfying his sexual demands&#8212;which came virtually anytime, anywhere&#8212;was an absolute requirement of her employment and of his legal representation. Giuliani began requiring Ms. Dunphy to work at his home and out of hotel rooms, so that she would be at his beck and call. He drank morning, noon, and night, and was frequently intoxicated, and therefore his behavior was always unpredictable.

7. Giuliani also took Viagra constantly. While working with Ms. Dunphy, Giuliani would look to Ms. Dunphy, point to his erect penis, and tell her that he could not do any work until &#8220;you take care of this.&#8221; Thus, Ms. Dunphy worked under the constant threat that Giuliani might demand sex from her at any moment. Even when the Covid-19 pandemic halted Giuliani&#8217;s ability to physically assault her, he demanded that she disrobe during their work-related videoconferences.

8. Giuliani also abused his position as Ms. Dunphy&#8217;s lawyer to pressure her into sex. In one instance, for example, Giuliani promised Ms. Dunphy that he would give her $300,000 if she would forgo her legal rights in connection with her pending case and &#8220;fuck me like crazy.&#8221; This statement was recorded.

9. As Ms. Dunphy continued her work for Giuliani and the Giuliani Companies, the work environment became increasingly hostile. In addition to his sexual demands, Giuliani went on alcohol-drenched rants that included sexist, racist, and antisemitic remarks, which made the work environment unbearable. Many of these comments were recorded.

Rudy fucked around so hard with the discovery process in the defamation case that today he received the ultimate find-out, a "fuck you; you're liable (https://storage.courtlistener.com/recap/gov.uscourts.dcd.238720/gov.uscourts.dcd.238720.94.0.pdf)" order from the federal judge presiding over the case. The judge entered judgment against Roodles as to liability on all the plaintiffs' claims as a sanction for discovery violations. The judge will set a three-day trial on damages only.

Roodles also got ordered to produce a bunch of records he should have produced long ago but didn't. He's individually liable for over $89K in attorney fees the plaintiffs incurred in connection with a prior motion to compel discovery, and is also liable for the as-yet undetermined fees they incurred in connection with their sanctions motion. Certain of Roodles' business entities are liable for over $43K in plaintiffs' attorney fees, with Roodles being personally liable if the businesses don't pay up. 

Couldn't happen to a shittier shitbag. :yup:

Here’s the thing: For an advice of counsel defense to stick, a defendant needs to satisfy a few key elements. One of them is that the client (here, Trump) needs to have made full disclosure of all the material facts to the lawyer. And that generally requires the lawyer to have actually fully understood what was conveyed.

It’s not hard to see why laying out all the facts to a lawyer blitzed off his ass would fail to qualify here. “I told my lawyer, but he was drunk” is likely not an effective advice of counsel defense.

A client also must also prove that he was acting in good faith by reasonably following that lawyer’s advice. Again, it’s not generally good faith to rely upon the advice of a lawyer whom you know to be drunk. On Election Night, for example, it was an allegedly soused Giuliani who advised Trump to go out and declare victory early, even while everyone else was frantically giving Trump the nix sign. If your drunk counsel advises something like that, while everyone else who is sober in the room pleads with you not to do it, it’s simply not good faith to follow the one drunk lawyer’s advice.

I wasn't following the trial that closely. I had learned what he said about testifying, but I didn't follow up on what he actually did.

Giuliani's trial and Alex Jones' trials all went down in more or less the same way: They fuck around with discovery, actively defying court orders and eventually getting a default judgement. They complain during the damages portion of the trial that they aren't able to defend themselves in court. They also continue to maliciously defame the people they maliciously defamed in the first place during the trial. Then they file for bankruptcy and pretend they can't afford the judgement against them. 

It just seems like the similarities imply a playbook only terrible people would use. :)

Here’s hoping the crapulous old tosspot ends up living in the Bowery Mission shelter, a couple of blocks from where I live. Then I might get the chance to point and laugh at him on the street.
